If an officer does something that is consistent with department policy that is extremely harmful to a U.S. Citizen then the officer should be charged in conspiracy with the department for enabling a bad policy. It is the best way to bring bad policies to light, to litigate them. After all, the police charge people remotely connected to criminal activity as co-conspirators, so treat them the same way and make the individual officers co-conspirators of any bad department policies.
