In a January 2026 interview, Johnson emphasized that judges should not bring personal politics to the bench, saying, “I don't bring my politics to work and I would not bring them to the Supreme Court.” He further argued that judges should “apply the law” rather than make policy, stating, “If the law is wrong, the legislature should write a better law.”
In In the Interest of W.S., 2026 ND 86 (2024), Johnson represented the State in seeking to uphold termination of a father’s parental rights after his three children had repeatedly been removed from his home because of drug use and domestic violence. Johnson argued that the statutory requirements for termination were satisfied and that the record showed reasonable reunification efforts, including supervised visitation, therapy, a case plan, family meetings and drug testing. The Supreme Court affirmed the termination, holding that a specific finding of “reasonable efforts” was not required at termination when the statutory requirements were otherwise met.
