Gibson pledges to "...faithfully apply the law and Constitution as written,” adding that he “will never use his office to show favoritism to a criminal defendant, or any other litigant” and will rule based on “the Constitution, statutes, and the common law.”
Gibson will not “not use discretion … to get around what the law is,” explaining that judges must uphold the law as written and how policy changes, such as abolishing cash bail, are matters for the Legislature.
Discussing cash bail, Gibson stated, "cash bail is constitutional," further explaining that the Eight Amendment of the U.S. Constitution "provides for it."
Gibson stated "appellate judges serve best when they focus on the law and the record rather than politics or personalities.”
Gibson said that judges have a lot of power in court. including deciding whether evidence can be used, and if a defendant is found not guilty, the state cannot usually challenge that decision.
Gibson "has researched and written about many areas of criminal law including:
- Fourth Amendment to the U.S. Constitution,
- The Confrontation Clause of the U.S. Constitution in sentencing proceedings,
- Texas's Confession Statute, and
- Confrontation Clause in Bail proceedings."
