RIGHT TO LIFE

Was Dobbs v. Jackson rightly decided according to the text of the Constitution? Please explain. (Holding: In Dobbs, the U.S. Supreme Court held that the federal constitution does not confer a right to abortion.)

Yes, Dobbs was rightly decided. The doctrine of substantive due process had no textual basis in the Constitution and served as an excuse for willful judges to interject the courts into moral issues that should have been resolved through the democratic process.

Does the federal Constitution support the right to physician assisted suicide? Please explain in light of Washington v. Glucksberg (1997).

No, the federal Constitution does not provide a right to physician assisted suicide. Again, substantive due process was a capacious doctrine that invited willful judges to interject courts into moral issues that should have been resolved through the democratic process. Washington v. Glucksberg correctly declined to recognize a constitutional substantive due process right to assisted suicide.

Human life deserves legal protection from conception until natural death.

Strongly Agree

How do you view the judiciary’s role in matters of abortion regulation following Dobbs?

The judiciary's role is to faithfully apply the laws passed by the legislature.

RELIGIOUS LIBERTY

Do you believe religious liberty is at risk in the United States. If so, what is the judiciary's proper role in addressing this issue?

Yes, the founders adopted the First Amendment because they knew that religious liberty could always be at risk. The judiciary can protect religious liberty by appropriately enforcing constitutional and statutory protections for religious exercise, such as the Free Exercise Clause, RLUIPA, and similar laws that exist at the state level.

Does the Establishment Clause of the First Amendment require government to be strictly secular or does it allow for the nation's religious heritage?

Our nation's religious heritage is consistent with the Establishment Clause. Willful judges in the 1960's and 70's improperly used the Establishment Clause to make rulings so hostile to religion that in many ways, religious expression was treated worse than secular forms of expression.

Was Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission rightly decided according to the text of the Constitution? Please explain. (Holding: The U.S. Supreme Court held tha the state may not show religious hostility when enforcing anti-discrimination laws against a business owner.)

Yes. It was clear from the facts of the case that many forces were conspiring against the baker Jack Phillips to prevent him from living according to his conscience.

VALUES

Briefly describe your spiritual beliefs and values.

I was born in a secular culture, but later came to believe in divinity and became a Christian. I believe in natural law, which posits that there are universal moral truths that are ascertainable by all people, even those who may not identify with a particular faith tradition.

What is your understanding of parental rights under the Constitution regarding the upbringing of children, particularly regarding choices about education and sexual identity?

Parents have a right to raise their children in accordance with their values. The U.S. Supreme Court affirmed this in the recent case of Mahmoud v. Taylor.

Is gender identity a protected class under the Constitution? Please explain the constitutional basis for your view.

No. Gender identity is not an immutable characteristic.

Have you ever been convicted of a felony? If so, please explain.

Have you ever been penalized for sexual misconduct in either civil or criminal court? If so, please explain.

JUDICIAL PHILOSOPHY

Describe your judicial philosophy.

Judges should exercise restraint and apply the law faithfully and dispassionately. When forced to make difficult decisions, judges should act according to their conscience rather than public opinion.

Do you believe judges should primarily apply the law according to its original public meaning, or do you believe the law evolves over time to reflect contemporary values?

Judges should primarily apply the law according to its originally public meaning.

Which current or past U.S. Supreme Court justice best reflects your judicial philosophy?

Justice Clarence Thomas. I admire his willingness to reexamine precedents and speak his views boldly.

Was Obergefell v. Hodges rightly decided according to the text of the Constitution? Please explain. (Holding: The U.S. Supreme Court held Due Process and Equal Protection Clauses create a right for same-sex couples to marry.)

No. In that case, the Supreme Court once again invoked a capacious view of "due process" to inject itself into a contested political issue that should have been left to the democratic process.

A. How should a judge approach a case where the constitutional or statutory text is clear on its face? B. Conversely, how should a judge proceed when the text is ambiguous or silent on a disputed issue?

The judge should follow the text when it is clear. When the text is ambiguous, the judge should apply the various techniques of statutory interpretation that exist to resolve the ambiguity in a way that is consistent with the rest of the laws.

What is your view of judicial restraint versus judicial activism? How do you define each?

I view judicial restraint as hesitating to--and generally preferring not to--inject courts into contested political issues so that they may be resolved through the democratic process. I strive to model judicial restraint. I view judicial activism as judges seizing on flimsy legal pretexts to weigh in on contested political issues in order to impose their will and preferences on society. Judicial activism should be avoided.

What is the proper role of a judge?

The role of the judge is to be a diligent, hardworking, and impartial listener and reader, and to decide cases in a consistent manner in accordance with the law.

When applying or interpreting the text of a statute or constitutional provision, is it ever proper for a judge to consider present day public opinion or consequences?

Potentially

If precedent departs from the Constitution’s text or original meaning, should a judge follow it or correct the error? Please explain.

A lower court judge will need to follow precedent out of respect for the hierarchy of the court system. A Supreme Court Justice should strive to correct erroneous precedents.

CRIMINAL JUSTICE & PUBLIC SAFETY

The burden of proof in a criminal case is generally that the state must provide proof beyond a reasonable doubt.  Some say the reason the burden of proof is so high is because we greatly value ensuring that the innocent are not unjustly imprisoned.  Please comment on this topic.

The burden of proof for criminal cases is a longstanding tradition that I respect and value. It's a burden that prosecutors meet in courtrooms across the country every week.

When reviewing wrongful conviction claims, what role, if any, should judges play in determining remedies?

Judges should follow the appropriate statutes and precedents that place limits on post-conviction review.

2ND AMENDMENT

What is your understanding of the Second Amendment’s right to keep and bear arms?

As the U.S. Supreme Court has held, the Second Amendment protects an individual right to keep and bear arms.
