Misc. Information:

  • In re Marshall, PR 06-0544 (Mont. Aug. 1, 2023)
    • “Douglas W. Marshall has filed an Amended Petition for reinstatement to active status in the State Bar of Montana. Marshall was placed on inactive status by the State Bar of Montana pursuant to Rules 3B2, 5, and 12 of the Rules for Continuing Legal Education (CLE) on September 13, 2022, as a result of noncornpliance with CLE requirements. Rule 13 of the CLE Rules provides that reinstatement may be granted by the Court upon 'certification by the [CLE] Commission that the attorney has completed the minimum continuing education requirements.' We denied without prejudice Marshall's previous." petition for reinstatement as it lacked documentation from the Comrnission certifying Marshall's completion of CLE requirements for the reporting year in question. That documentation is here provided. While the Amended Petition does not indicate whether Marshall is currently suspended or subject to disciplinary proceedings in another jurisdiction, Marshall's original petition, filed May 10, 2023, certified he was not, which we accept for purposes of this petition”

QUESTIONNAIRE

RIGHT TO LIFE

Was Dobbs v. Jackson rightly decided according to the text of the Constitution? Please explain.

Yes.

I support a right to accelerate ending a human life.

Disagree

Human life deserves legal protection from conception until natural death.

Neutral

RELIGIOUS LIBERTY

Religious liberty is at risk in the United States.

Strongly Agree

VALUES

Briefly describe your spiritual beliefs and values.

I believe in an Unknowable G-d and the principles set forth in Judaism and Protestant Reform Christianity.

What is your view of parental rights regarding the upbringing of children, specifically education and sexual "identity"?

I believe parents have a right and obligation to protect their children until those children are legally and practically competent to make their own decisions.

I support "gender identity" as a specially protected class. Please explain.

Neutral

iVoterGuide Notes:

“After the voter guide was published, the candidate notified iVoterGuide that they intended to answer this question as ‘Strongly Disagree.”

What do you believe to be true about the human condition?

We are a broken people that can become better. The Torah, Tanuch and the Gospel of Jesus, Mary and the Gnostics are helpful in learning how to live with G-d's Grace.

Neutral

ABOUT YOU

What, if any, church or organizations do you belong to?

Roberts United Methodist Church, Bozeman United Methodist Church, Congregation Beth Shalom Bozeman.

I voted in these primaries and general elections:

2014 Republican Primary 2014 General Election 2016 Republican Primary 2016 General Election 2020 Democratic Primary 2020 General Election

Have you ever been convicted of a felony? If so, please explain.

No.

Have you ever been penalized for sexual misconduct in either civil or criminal court? If so, please explain.

No.

Would you describe your judicial philosophy as originalist, living constitutionalist, or something else? Please explain.

I am an originalist with regard to the Montana Constitution and something of a textualist with regard to the U.S. Constutution.

JUDICIAL PHILOSOPHY

Which current or past U.S. Supreme Court justice best reflects your judicial philosophy?

John Marshall

Is there a separation of church and state in the Constitution? Please explain.

Yes and No. See the text of the First Amendment. The Establishment Clause does not create an un-enumerated right to be free from religion. I do not believe that ANY religion should be forced directly or indirectly on anyone without their consent- which would, effectively, constitute a rape of one's soul.

Should courts address threats to religious liberty in the United States? If so, how?

Yes, on a case by case basis.

Was Obergefell v. Hodges rightly decided according to the text of the Constitution? Please explain.

I have not read it

Was Bostock v. Clayton County rightly decided under the law? Please explain.

I have not read it.

I agree that “the custody, care and nurture of the child reside first in the parents, whose primary function and freedom include preparation for obligations the state can neither supply nor hinder.” (Troxel v. Granville, 530 U.S. 57, 65-66 (2000); quoting Prince v. Massachusetts, 321 U.S. 158, 166 (1944).

Strongly Agree

What should a judge do when legislative texts and court precedents dictate different results?

It depends on the case.

When should a judge overturn past court decisions?

When it becomes evident that the original decision was wrong.

When, if ever, should a judge take popular opinion or the social views of the majority into consideration?

It depends on the case.

Do you believe the meaning of the Constitution changes over time, absent changes through the amendment process of Article V?

Choose not to answer

What do you believe is the single most important quality a judge should possess?

Independence from Man, coupled with respect for but not homage to the word of G-d.

If you are an incumbent judge, describe a recent instance in which you acted to preserve your judicial independence. If you are an aspiring judge, how do you plan to remain independent if elected to the bench?

Prayer. Faith. Courage. Openness to hearing the True Word of the Lord.

2ND AMENDMENT

The right to bear arms is fundamental and must be protected.

Strongly Agree

OTHER IMPORTANT ISSUES

Which branch of government do you believe was intended to wield the most authority?
