Was Dobbs v. Jackson rightly decided according to the text of the Constitution? Please explain.

Yes. Neither the 14th Amendment, nor any other provision of the U.S. Constitution, can reasonably be read to create a constitutional right to an abortion in circumstances other than where there is an immediate danger to the life of the Mother.

I support a right to accelerate ending a human life.

The government should not interfere in the relationship between a citizen and their doctor, unless providing, or failing to provide, the contemplated medical treatment rises to the level of a violation of well established, fundamental rights, such as the right to life. An example would be a Court permitted a blood transfusion to save the life of a minor, over the objections of the parents.

Human life deserves legal protection from conception until natural death.

The foundational laws of this country, embodied in the U.S Constitution, preserve and protect the rights of individuals to make their own decision with respect to how to live their life, including medical decisions that impact only themselves. However, when one individual contemplates a medical decision that will cause actual harm to another, the government does have a limited role in protecting its citizens, including their right to life.


RELIGIOUS LIBERTY

Religious liberty is at risk in the United States.

Individuals have the right to believe, and worship, in accordance with their own conscience. The separation of Church and State is an important component in the U.S. form of Government. As in many other areas of life, the government has increasingly injected itself into the religious affairs of its citizens, often with unintended consequences. The government should not interfere with the free exercise of religion, unless and until that exercise creates an unreasonable risk of harm to others.


2ND AMENDMENT

The right to bear arms is fundamental and must be protected.

"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." The language means what it says. "Shall not be infringed" literally means, SHALL NOT BE INFRINGED.

Yes. While the US Constitution does not expressly use the phrase "Separation of Church and State", it does expressly state: "Congress shall make no law respecting an establishment of religion."

Should courts address threats to religious liberty in the United States? If so, how?

Yes, Courts should address threats to religious liberty in the United States. People should be free to practice their religion without government interference up until the point where they interfere with the protected freedoms of others.

Was Obergefell v. Hodges rightly decided according to the text of the Constitution? Please explain.

No. Neither equal protection of the law, substantive due process, nor the full faith and credit clause can create a fundamental right where none exists, judicial wishes notwithstanding. The constitution is silent ono marriage and domestic relations, which have been historically been the exclusive purview of the states. The Court created law out of whole cloth, finding a new fundamental right based on an unenumerated, undefined privacy right that was created entirely via judicial activism.

Was Bostock v. Clayton County rightly decided under the law? Please explain.

No.

I agree that “the custody, care and nurture of the child reside first in the parents, whose primary function and freedom include preparation for obligations the state can neither supply nor hinder.” (Troxel v. Granville, 530 U.S. 57, 65-66 (2000); quoting Prince v. Massachusetts, 321 U.S. 158, 166 (1944).

What should a judge do when legislative texts and court precedents dictate different results?

The role of the appellate courts is to interpret the law, in light of the hierarchy of laws, of which the Constitutions are the supreme law of their respective territories. The highest appellate court in each jurisdiction, of which the CCA is one, is tasked with not only interpreting the law, but changing or invalidating the law, in appropriate circumstances, including over ruling existing case law based on changing circumstances. If the legislative text is clear, then laws properly passed by the legislature have priority over case law, unless the statute violates the Constitution.

When should a judge overturn past court decisions?

The highest appellate court in each jurisdiction, of which the CCA is one, is tasked with not only interpreting the law, but changing or invalidating the law, in appropriate circumstances, including over ruling existing case law based on changing circumstances. When an existing statue is in conflict with newly created law, or a new statute is in conflict with a provision of the State or Federal law, or when a previous decision is shown to be incorrect, then a Judge should overturn past decision. Roe v Wade is a good example.

When, if ever, should a judge take popular opinion or the social views of the majority into consideration?

Almost never.

Do you believe the meaning of the Constitution changes over time, absent changes through the amendment process of Article V?

No

The Constitution says what it says. Words have meaning. If it is desirable to change the Constitution to more closely match changing social values, their is a mechanism built into the Constitution for that purpose. It is inappropriate for a Court to simply "redefine" existing language to suit the ends of Judicial Activism.

What do you believe is the single most important quality a judge should possess?

Integrity. A Judge must be internally consistent. Opinions must be predictable, and based on well reasoned arguments based on fundamental principles.

If you are an incumbent judge, describe a recent instance in which you acted to preserve your judicial independence. If you are an aspiring judge, how do you plan to remain independent if elected to the bench?

I will remain independent as I will follow the literal text of the law, which is not dependant on social views of any class or interest group.

Briefly describe your spiritual beliefs and values.

I am a Christian Conservative. I believe strongly in the freedom of religion, and the right of each person to worship in the manner that they deem appropriate, so long as they do not intrude upon the rights of others.

What is your view of parental rights regarding the upbringing of children, specifically education and sexual "identity"?

Parents have a fundamental right to raise their children as they see fit, up to the point where they are causing a significant risk of harm to the child. Altering a minor's sexual identity with surgery or hormone therapy is child abuse.

I support "gender identity" as a specially protected class. Please explain.

Disagree

There are only two genders. Gender is not "assigned" by a Doctor at birth, no more than a birthdate is. The doctor merely observer the gender, and writes it down, much as the Doctor observes the date of birth, and writes it on the birth certificate. If a person chooses to believe they are a cat, that is their business, but that doesn't mean I have to pet them. A person has a fundamental right to be wrong, but they have no right to force me to agree with them.

What do you believe to be true about the human condition?

The Human condition can be defined as the characteristics and key events of human life, including birth, learning, emotion, aspiration, morality, conflict, and death. All Human life is sacred, and endowed by the creator with the right to life, liberty and the pursuit of happiness.

I agree with Critical Race Theory (CRT).

Race is not a social construct, no more than height or weight. Race is a collection of physical traits based on geographic ancestry. CRT is divisive and often counterproductive. The excessive use of narrative in CRT is not an effective teaching method, particularly in a legal of criminal justice context.
