Justice Winfree was nominated to the Alaska Supreme Court in 2007 by Gov. Sarah Palin.

In 2012, the Judicial Council announced that it "finds Justice Winfree to be Qualified and recommends unanimously that the public vote 'YES' to retain him as a supreme court justice."

Justice Winfree is a former president of the Alaska Bar Association.

In Justice Winfree's 2007 application to the Alaska Supreme Court, he wrote, "I'm a third-generation Fairbanksan, born in Territorial Alaska, raised by the Golden Rule and the Code of the North, and encouraged to make a difference."

Justice Winfree signed a 2020 letter that said, "We recognize that too often African-Americans, Alaska Natives, and other people of color are not treated with the same dignity and respect as white members of our communities. And we recognize that as community members, lawyers, and especially as judicial officers, we must do more to change this reality."

Justice Winfree joined the Alaska Supreme Court majority in State v. Planned Parenthood (2019), which held that the Alaska Constitution guarantees women a constitutional right to Medicaid funding for medically unnecessary abortions.
