Justice Keynen Wall Jr was appointed to the Kansas Supreme Court in August of 2020 by Governor Laura Kelly (D) to fill the vacancy of Lawton Nuss. He was a judicial clerk for John Lungstrum. He was a partner at Forbes Law Group, LLC and “represented county hospitals, rural healthcare providers, and community mental health centers throughout Kansas.” [source] Prior Justice Keynen was senior legal counsel at Federated Insurance in Minnesota. Notable Cases:
- In Butler v. Shawnee Mission School District Board of Education Wall joined Biles opinion. Parents of students brought constitutional challenge statute requiring face masks in schools during COVID-19. Held the court did not have jurisdiction to decide parents claim because SB 40 did not apply to the challenge. Found attorney general intervention allowed for appeal of holding. Found the attorney general was entitled to appeal the case. Held the trial court should have decided constitutionality due to doctrine of constitutional avoidance.
- In State v Rinke Wall signed the pur curiam opinion. Defendant after engaging in intercourse resulting in the strangulation and death the victim was charged with felony murder and aggravated kidnapping. Court held the state failed to present substantial competent evidence that the crimes were for the purpose of sexual gratification. And defendant did not need to register as a sex offender.
- In the Matter of MARTY K. CLARK concurred in Justice Stegall's concurrence. Case involved former Justice who had posted nude photos of himself to a swingers website. The court held the former Justice had violated rules. The concurrence argued that the conduct of the justice was "grossly immoral"; however they disagree that the court should take action as there is no violate and said "let us be clear--the behavior were talking about consists entirely of the lawful, private, consensual sexual practices of Judge Clark. Behavior that was only discovered by the Examiner and the Commission because it was disclosed by a disgruntled participant in that behavior."
