Justice Whitener signed a 2020 letter that said, "The legal community must recognize that we all bear responsibility for this on-going [racial] injustice, and that we are capable of taking steps to address it, if only we have the courage and the will."

Justice Whitener was appointed by Governor Jay Inslee to the Pierce County Superior Court in 2015 and then to Washington Supreme Court on April 13, 2019. iVoterGuide has rated Governor Inslee as “Very Liberal,” and Governor Inslee has received a 100% vote rating from Planned Parenthood and a 94% vote rating from Human Rights Campaign.

  • Justice Whitener joined the Washington Supreme Court majority in State v. Blake (2021), which held that a drug-possession law criminalized the unintentional possession of drugs and was therefore unconstitutional.
  • Justice Whitener joined the dissent in Leishman v. Ogden Murphy Wallace, PLLC (2020), in which the majority of the Washington Supreme Court held that a gay man alleging discrimination could not carry out a retaliatory lawsuit against a government contractor.
  • Justice Whitener signed the majority opinion in State v. Martinez (2020), which held that certain hearsay testimony can be used as evidence in rape trials even though hearsay is generally not admissible in court.
