Was Dobbs v. Jackson rightly decided according to the text of the Constitution? Please explain. (Holding: In Dobbs, the U.S. Supreme Court held that the federal constitution does not confer a right to abortion.)

Yes. The Court correctly held that a constitutional right to abortion has never existed in text of the Constitution.

Does the federal Constitution support the right to physician assisted suicide? Please explain in light of Washington v. Glucksberg (1997).

No. Such a right does not appear in the text of the Constitution.

How do you view the judiciary’s role in matters of abortion regulation following Dobbs?

Regulations are passed by the legislative branch, not the judicial branch. The judicial branch's role is limited to deciding questions of whether regulations passed by the legislative branch pass constitutional muster.

Do you believe religious liberty is at risk in the United States. If so, what is the judiciary's proper role in addressing this issue?

Liberty of any kind must always be protected vigilantly. Religious practices are protected specifically by the Consitution so any laws that touch religious practices deserve the strictest scrutiny.

Does the Establishment Clause of the First Amendment require government to be strictly secular or does it allow for the nation's religious heritage?

The Establishment Clause forbids only the establishment of an official state religion. It allows for the nation's religious heritage.

Was Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission rightly decided according to the text of the Constitution? Please explain. (Holding: The U.S. Supreme Court held tha the state may not show religious hostility when enforcing anti-discrimination laws against a business owner.)

Yes. The Constitution provides for strict scrutiny of any law infringing on religious beliefs.

Parents have the primary responsibility for their children's upbringing. That includes all decisions and choices affecting that child (within the bounds of the law)..

The concept of "gender identity" does not appear in the text of the Constitution, so no.

JUDICIAL PHILOSOPHY

Describe your judicial philosophy.

Judges are charged with interpreting and applying the law as written by the legislative branch and applied by the executive branch. Judges should never make law to suit their particular beliefs. That is the essence of judicial conservatism.

Do you believe judges should primarily apply the law according to its original public meaning, or do you believe the law evolves over time to reflect contemporary values?

I am a textualist and an originalist. That means I give plain meaning to the text of the law as it is written and when it was written. I agree with Justice Samuel Alito that historical tradition also plays a role depending on the circumstances. The American legal system is not designed to bend with the whims of the times.

Which current or past U.S. Supreme Court justice best reflects your judicial philosophy?

Antonin Scalia.

Was Obergefell v. Hodges rightly decided according to the text of the Constitution? Please explain. (Holding: The U.S. Supreme Court held Due Process and Equal Protection Clauses create a right for same-sex couples to marry.)

Issues affected by this case may come before me, so the Texas Code of Judicial Conduct prevents me from commenting on this question.

A. How should a judge approach a case where the constitutional or statutory text is clear on its face? B. Conversely, how should a judge proceed when the text is ambiguous or silent on a disputed issue?

A. This is an easy situation. Apply the canons of statutory construction. B. Here, a judge should apply the canons of statutory construction and consider the evidence, if any, of the legislative meaning. A judge should also give plain and common meaning to the text as the legislative branch wrote it.

What is your view of judicial restraint versus judicial activism? How do you define each?

Judicial restraint, or judicial conservatism, is the proper philosophical approach, and it is my approach. I rule based on the facts and the law. Judicial activists go outside the law to try and impost their own personal policy goals.

What is the proper role of a judge?

To rule according to the facts and the law and to decide cases promptly.

When applying or interpreting the text of a statute or constitutional provision, is it ever proper for a judge to consider present day public opinion or consequences?

No.

If precedent departs from the Constitution’s text or original meaning, should a judge follow it or correct the error? Please explain.

This depends on a particular case and its posture. If the issue is squarely before the court, then it may be proper to correct the error. If the issue is not squarely before the court, a conservative judge should be careful to decide the case within its bounds and not impose his or her own will on the matter.

What is your understanding of the Second Amendment’s right to keep and bear arms?

The Second Amendment to the U.S. Constitution clearly establishes an individual right to keep and bear arms.

Which branch of government do you believe was intended to wield the most authority?

None. The system provides, in a sense, equal authority among the branches depending on the issue in question. On any given day, however, one branch may be in charge of the issue, so in that sense is the most powerful. In Texas, this is an easy question because all officials are elected by the people.
