Gardner believes in the protection of life "at all stages". “I'm pro-life, but that's up to the states.” Since he was first elected to Congress as a Representative in 2010, Gardner has voted to defund Planned Parenthood a total of nine times. Gardner voted in favor of the “Pain-Capable Unborn Child Protection Act” that would have banned abortions after 20 weeks and threatened doctors who perform those abortions with up to five years in jail.

Gardner has voted ten times to defund Planned Parenthood since he has held Federal office.

Gardner sponsors the Born-Alive Abortion Survivors Protection Act.

“Socialized medicine means less choice, higher taxes and longer wait times and more government control,” Gardner said during the Western Conservative Summit in downtown Denver. “It means losing the health care that you have at your job and having it replaced with government-run healthcare. It’s so free that it’s unavailable. … We know that Democrats’ Medicare for All will actually result in Medicare for none.”

Gardner voted in favor of the Stop Sanctuary Policies and Protect America Act, which prohibits funds from going towards sanctuary cities. He voted aye on cloture needed to pass the bill.

Gardner introduced legislation that contains "permanent authorization of voluntary e-Verify".

Gardner voted nay to Amendment to fund pre-K education and to Amendment to tax the wealthy and use the revenues to provide for free community college, to an amendment to restore funding for Pell grants, and to an amendment to establish pre-kindergarten programs for low income families, voted aye to an amendment to introduce voucher program to ECAA and to Every Student Succeeds Act.

Gardner voted against adding sexual orientation to non-discrimination laws.

Gardner does not support BDS. He sent a letter to Senate Majority Leader Mitch McConnell and Minority Leader Chuck Schumer with 14 of his colleagues, urging them to take action against the anti-Israel and anti-Semitic Boycott, Divestment, and Sanctions (BDS) movement.
