OTHER INFORMATION

In an interview at NCADA’s 14th Biennial Judicial Candidates’ Forum, Stevens expressed her concern over the court being “too far activist” and that she will be a Justice who remains “a constitutional conservative” with a “strict interpretation of the constitution.” She stated that “it’s not a place to be making law” and that it was the legislature’s job, not the court’s.

QUESTIONNAIRE

RIGHT TO LIFE

Was Dobbs v. Jackson rightly decided according to the text of the Constitution? Please explain. (Holding: In Dobbs, the U.S. Supreme Court held that the federal constitution does not confer a right to abortion.)

Yes. They returned the matter to the States because there was no right to an abortion in the U.S. Constitution. If there was none, the matters are the province of the state.

Does the federal Constitution support the right to physician assisted suicide? Please explain in light of Washington v. Glucksberg (1997).

The states do have the right to determine the regulations regarding assisted suicide. The constitution recognizes the right to life and any right to have an individual's right to take his or her own life would be the province of the state. The legislature has the right to weigh in on this issue. The question for the legislature is whether it is a crime. We do allow Hospice to provide palliative which can assist with end of life.

Human life deserves legal protection from conception until natural death.

Agree

There is nothing to require that contraception be allowed. Once conception occurs the legislature has determined when a fetus is viable. Abortion has been the law of the land for 70 years and has been expanded by some states to include abortion until birth. The question for the Court is whether the law imposed is extreme and whether the child is viable at that point to constitute death.

How do you view the judiciary’s role in matters of abortion regulation following Dobbs?

It could be murder if done while the child is viable. Otherwise, the law of the state is controlling as to ramifications.

RELIGIOUS LIBERTY

Do you believe religious liberty is at risk in the United States. If so, what is the judiciary's proper role in addressing this issue?

Judicial activist are making the law rather than following it. They are deciding what the law is as they want it to achieve a certain outcome.

Does the Establishment Clause of the First Amendment require government to be strictly secular or does it allow for the nation's religious heritage?

Religious freedom is a right to each individual and not to be used as a weapon by others

Was Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission rightly decided according to the text of the Constitution? Please explain. (Holding: The U.S. Supreme Court held tha the state may not show religious hostility when enforcing anti-discrimination laws against a business owner.)

yes

VALUES

Briefly describe your spiritual beliefs and values.

I am a Christian and believe that people are inherently good and deserve grace. I also believe that each individual has free will and should be responsible for his or her actions. There is accountability expected of each citizen. The legislature creates law which is the foundation of society. If we make excuses for bad actions, we have lowered expectations for all citizens.

What is your understanding of parental rights under the Constitution regarding the upbringing of children, particularly regarding choices about education and sexual identity?

The parents have the right to determine what their children learn about sexuality and identity. The purpose of schools is to teach basic reading, writing, and math skills. The schools should teach children critical thinking skills. After a lesson, the children should not know about the teacher's sexual preference, sexual tendencies, and what political leanings the teacher has. Schools are a requirement under the state constitution but was never intended to be an indoctrination area.

Is gender identity a protected class under the Constitution? Please explain the constitutional basis for your view.

I have not seen a legal argument that justifies gender identity as a protected class. There are two genders, male and female. Sexual surgery is a mutilation of the body and does not change a person to another sex.

Have you ever been convicted of a felony? If so, please explain.

JUDICIAL PHILOSOPHY

Describe your judicial philosophy.

I am a strict construction constitutionalist. I believe a justice is a referee and not a king. Their job is to follow the law as it is written not as they want it to be.

Do you believe judges should primarily apply the law according to its original public meaning, or do you believe the law evolves over time to reflect contemporary values?

The constitution is full of basic truths and not evolve over time. There are times when it may need to be clarified but that is done through constitutional amendments, not under the limited capacity of the Supreme Court.

Which current or past U.S. Supreme Court justice best reflects your judicial philosophy?

Justice Amy Comey Barrett

Was Obergefell v. Hodges rightly decided according to the text of the Constitution? Please explain. (Holding: The U.S. Supreme Court held Due Process and Equal Protection Clauses create a right for same-sex couples to marry.)

Marriage and it's limits belong to the States and is not and should not be a federal issue

A. How should a judge approach a case where the constitutional or statutory text is clear on its face? B. Conversely, how should a judge proceed when the text is ambiguous or silent on a disputed issue?

If the constitutional or statutory text is clear, you follow them. If they are not clear, you follow the text to its common sense meaning and not use that as an opportunity to reach a goal of the judge.

What is your view of judicial restraint versus judicial activism? How do you define each?

Judicial restraint is following the law as written. An activist looks at a case to see if she can make her own law or create a unique interpretation of the constitution.

What is the proper role of a judge?

Follow the law as written and not as you might want it to be. Ensure that the Constitution is followed.

When applying or interpreting the text of a statute or constitutional provision, is it ever proper for a judge to consider present day public opinion or consequences?

No

If precedent departs from the Constitution’s text or original meaning, should a judge follow it or correct the error? Please explain.

If it is clearly departing for the Constitution as it has at times under the liberal court, the Court has an obligation to correct it.

CRIMINAL JUSTICE & PUBLIC SAFETY

The burden of proof in a criminal case is generally that the state must provide proof beyond a reasonable doubt.  Some say the reason the burden of proof is so high is because we greatly value ensuring that the innocent are not unjustly imprisoned.  Please comment on this topic.

We do respect that burden of proof because the consequences of doing less would take away a right under the constitution like the right to life or liberty.

When reviewing wrongful conviction claims, what role, if any, should judges play in determining remedies?

Were there procedural errors? The burden of beyond a reasonable doubt has been applied to the case so now the convicted person should have a very high standard for overturning that conviction.

2ND AMENDMENT

What is your understanding of the Second Amendment’s right to keep and bear arms?

It is a right and there must be a compelling reason to make any restrictions. I have not seen any except with convicted felons.

OTHER IMPORTANT ISSUES

Which branch of government do you believe was intended to wield the most authority?

The legislature has the power to create the laws and it is composed of representatives of the people. They are required to answer to the voters every 2 years. The Court is ensure that those laws are consistent with the constitution.
