Do you want to amend the Missouri Constitution to: 

  • establish a right to make decisions about reproductive health care, including abortion and contraceptives, with any governmental interference of that right presumed invalid; 
  • remove Missouri’s ban on abortion; 
  • allow regulation of reproductive health care to improve or maintain the health of the patient; 
  • require the government not to discriminate, in government programs, funding, and other activities, against persons providing or obtaining reproductive health care; and 
  • allow abortion to be restricted or banned after Fetal Viability except to protect the life or health of the woman? 

WHAT IT MEANS

Yes

A "Yes" vote means that you desire to remove Missouri's current ban on abortion and amend the Missouri Constitution to:

  • prevent the government from infringing on a person's right to reproductive freedom. This would erase all common sense protections for women, minors, and the unborn. This includes parental consent for minors seeking an abortion and allows for gender transitioning procedures for minors.
  • allow abortion through fetal viability, and after viability to protect the mother's life, physical, or mental health. The broad exceptions created for the mental health of the mother can be used to justify abortion at any point in pregnancy.
  • protect from prosecution any person having or assisting in an abortion. This would prevent the prosecution of sex traffickers when they bring their victim to have an abortion. It would also prevent the prosecution of an abortion provider for malpractice.

A "Yes" vote would prevent future legislative attempts to regulate abortion.

No

A "No" vote will keep the law prohibiting abortion in Missouri which includes:

  • exceptions in the case of medical emergency.
  • protection from prosecution for the woman having the abortion.

A "No" vote would allow future legislative attempts to regulate abortion.

  • “Right now, Missouri has a total abortion ban, even for survivors of rape and incest. Women in Missouri can’t receive abortion care, even if their health is at risk. The decision of whether or not to have an abortion is a personal choice that should be made by Missourians, their families, and their health care providers – not politicians in Jefferson City.  Passing this amendment will end our state’s total abortion ban and make sure Missourians and their families can make the decisions that are right for them.” - Missourians for Constitutional Freedom 

  • “Right now in Missouri, abortion is banned, patients are being turned away from emergency rooms, and doctor’s hands are tied by politicians. This amendment is about making sure pregnant Missourians get the care they need without delay or restrictions.   • “Amendment 3 supporters want the term “reproductive freedom” inserted into the Missouri Constitution, paving the way for gender transition surgeries for minors without parental consent and men in women’s locker rooms, in addition to taxpayer-funded abortion for any reason in the 7th, 8th and 9th months of pregnancy, all permanently enshrined in the Missouri Constitution.” - Missouri Stands With Women 

  • “This proposed amendment to our state constitution is an extreme proposal that would allow full-term abortion with no protections for the preborn child, including when the child is capable of feeling pain. The proposed amendment would effectively eliminate common-sense state regulations that have protected Missouri women for years. These include health and safety requirements for abortion clinics; the requirement that only a medical doctor be allowed to perform abortions in the state; and that parents of a minor be notified before she can have an abortion. Amendment 3 would allow for unregulated abortions until viability–approximately six months into a pregnancy. After viability, the proposed amendment would create a broad mental health exception that a healthcare provider could exploit to allow abortion in the 7th, 8th, or 9th months of pregnancy. Amendment 3 would also prohibit any type of penalty for someone who assists a person in “exercising their right to reproductive freedom”.   • “If a “right” to abortion is enshrined in our Missouri Constitution it would allow abortions to be performed on pregnant minors without notice to or consent from the minor’s parents. f our Missouri Constitution is amended with a “right” to abortion, abortion will be allowed for “physical or mental health” for all 9 months from conception to live birth. Missouri health and safety standards for abortion clinics would be gutted if this amendment passes. Its language would even allow some unlicensed persons to perform or induce abortions. Our Missouri Constitution is our state’s supreme (highest) law and governing document. Our pro-life laws in more than sixty sections of the Revised Statutes of Missouri will be eliminated by enshrining a “right” to abortion in our Missouri Constitution. A woman’s ability to seek criminal prosecution/civil penalty of any person who performs/assists/provides support to induce/ seek/obtain an abortion will be eliminated. If abortion is enshrined as a “right” in our Missouri Constitution, your legislator will be unable to refuse to appropriate funds to abortion providers.” - Missouri Right to Life 

  • A pro-abortion measure is on the ballot Nov. 5 in Missouri. It’s titled “Right to Reproductive Freedom.” It’s important that Missouri Baptists understand the threat this measure poses to unborn life, and the responsibility we shoulder to stand for life on Election Day. A “no” vote means that Missouri’s current pro-life laws would remain on the books. Missouri has historically been a leader in the pro-life movement, with strong laws that reflect the value we place on life at all stages. A “yes” vote supports amending the Missouri Constitution to provide the right for “reproductive freedom,” prevents the state Legislature from enacting any law to protect the preborn prior to “fetal viability,” and allows late-term abortion if keeping the child would affect the mother’s “mental health.” - Missouri Baptist Convention
