BALLOT LANGUAGE

CI-128 amends the Montana Constitution to expressly provide a right to make and carry out decisions about one’s own pregnancy, including the right to abortion. It would prohibit the government from denying or burdening the right to abortion before fetal viability. It would also prohibit the government from denying or burdening access to an abortion when a treating healthcare professional determines it is medically indicated to protect the pregnant patient’s life or health. The initiative would prevent the government from penalizing patients, healthcare providers, or anyone who assists someone in exercising their right to make and carry out voluntary decisions about their pregnancy.

WHAT IT MEANS

YES

A "Yes" vote means that you desire to amend the Montana Constitution such that:

  • Abortion will be legal at any stage of pregnancy up until birth, including partial birth abortion.
  • "Health care professional" is not defined and could include a doctor, nurse, dentist, chiropractor, physical therapist,  paramedic, etc.
  • Parents will not be notified of a minor child seeking an abortion.
  • Cover is provided for those who victimize underage females through abuse, trafficking or other such crimes.
  • "Fetal viability" is at the discretion of the "health care professional".

NO

A "No" vote will keep the current law regarding abortion in Montana which states that:

  • Abortion is legal until fetal viability, which is typically 24-26 weeks.
  • Parental notice is required, but not consent, for a minor to obtain an abortion.
  • State Medicaid funds may be used to cover abortions.
  • Abortions can be performed by any qualified healthcare professional, not only licensed physicians.
  • Montana protects anyone entering an abortion clinic from harassment and physical harm.

  • “CI-128 would create a constitutional right to UNLIMITED ABORTION in Montana -- including partial-birth abortion or dismemberment abortion. A “healthcare professional” meaning a doctor, nurse, dentist, chiropractor, physical therapist, or paramedic, can approve abortion AT ANY STAGE OF PREGNANCY. Predators and sex traffickers will be protected when they force victims to obtain an abortion, and parents will not be entitled to notice or consent before their daughter obtains an abortion. CI-128 is about more than abortion. The broad language of CI-128 includes phrases like “reproductive care, ” which arguably creates a right for anyone--including minors--to undergo radical, irreversible gender reassignment surgery or hormone intervention to alter the reproductive system. ” - Montana Life Defense Fund

"CI-128 is being promoted simply as a protection for women’s rights, when in fact, this initiative seeks to enshrine legal authorization for the following:

  • Late-term abortion of babies who will feel pain
  • Abortion of babies who have been partially delivered
  • Abortion by dismemberment of children growing in the womb

Moreover, this proposal would eliminate current parental notification requirements that apply when minors obtain an abortion. This would:

  • Impose a culture of secrecy that would undermine families
  • Expose underage mothers to exploitation
  • Provide cover for those who would victimize underage women by committing abuse, human trafficking, and other crimes"
