BALLOT LANGUAGE

Nevada Reproductive Rights Amendment states that a new section, designated Section 25, be added to Article 1 of the Nevada Constitution to read as follows: Sec. 1. All individuals shall have a fundamental right to abortion performed or administered by a qualified health care practitioner until fetal viability, or when needed to protect the life or health of the pregnant patient, without interference from the state or its political subdivisions. The right established by this section shall not be denied, burdened, or infringed upon unless justified by a compelling state interest that is achieved by the least restrictive means.

WHAT IT MEANS

Yes

A "Yes" vote means that you desire to amend the Nevada Constitution such that: 

  • Abortion is legal until fetal viability and after viability to protect the life or health of the mother. "Health of the mother" is an ambiguous term and would allow abortion at any point in pregnancy for essentially any reason.
  • Any "qualified heath care practitioner" can determine if abortion is necessary after fetal viability. "Qualified health care practitioner" is not defined and could include a doctor, nurse, dentist, chiropractor, physical therapist, paramedic, etc.

No

A "No" vote will keep the current law regulating abortion in Nevada, which states that:

  • Abortion is allowed within the first 24 weeks of pregnancy when performed by a licensed physician and after 24 weeks to preserve the life or health of the pregnant individual.
  • Parental consent must be obtained in the case of a minor seeking abortion, unless the minor obtains a court order allowing the abortion.

  • “After the Supreme Court overturned federal protections for abortion rights last summer, anti-abortion state legislatures, judges and activists have been working overtime to enact cruel abortion bans and other restrictions on sexual and reproductive health care. With this constitutional amendment we are saying enough is enough.   • [The] amendment is vague. Take a look for yourself. “All individuals” means regardless of age or gender. This eliminates parental involvement. How will judges interpret a biological male’s right to abortion? “Qualified healthcare practitioner” REPLACES “licensed physician.” “Fetal viability” is defined by the “healthcare practitioner.” There is no date or objective standard. Current law is 6 months, but that limitation is removed. “Without interference from the state or its political subdivisions” closes the door on health and safety regulations. Even nail salons must meet state health and safety standards. - Nevada Amendment Truth

  • “Abortion is already legal up until 24 weeks or 6 months in the state of Nevada. This amendment would legalize abortion up until moments before birth. The amendment would allow for any minor girl to receive an abortion without any parental notification. The amendment would nullify many health and safety protections for women such as requiring a licensed doctor.
