Proposition 134

BALLOT LANGUAGE

Shall there be a change to the Colorado Revised Statutes creating new law restricting participation in all K-12 and collegiate school sports based on the participant’s sex as determined by certain aspects of their biological reproductive system, and, in connection therewith, requiring a school, institution of higher education, or athletic association to designate each school or intramural athletic team or sport as male, female, or coeducational; only allowing participants to compete on the team or sport of their designated sex or to compete on a coeducational team; creating an exception to allow a female to participate on a male-designated team or sport if there is no female team available; prohibiting a government entity, licensing or accrediting organization, or athletic association from entertaining a complaint, opening an investigation, or taking other adverse action against a school for maintaining separate teams or sports for females; and providing the commissioner of education with the authority to enforce the proposed initiative for K-12 school districts?

WHAT IT MEANS

Yes

A “Yes” vote would amend Colorado Statute to require participation in all K-12 and collegiate school sports to be based on a student’s biological sex, require teams to be designated as male, female, or coeducational, and allow females to play on a male team if there are no female teams available.

No

A “No” vote would keep current Colorado Statute which allows students to play on school sports teams based on their gender identity. 

ARGUMENTS FOR AND AGAINST

“It's not fair – It's not safe. Bigger, stronger biological males are invading girls' sports in Colorado, taking away our girls' dignity, safety, and opportunity. Our ballot measure ensures girls' sports are protected, requiring sports leagues and teams be specifically designated male, female, or co-ed. Because girls' sports in Colorado should be for girls. “Female athletes deserve dignity, safety and equal opportunity. This citizen initiative protects female athletes by ensuring an even playing field. 

The measure requires Colorado athletic teams be specifically designated as male, female or co-ed. It unequivocally declares only biological females will play in female sports.” - Focus on the Family 

“Initiative #109 affirms the "unique and immutable biological differences" between men and women from birth and that those differences become more pronounced as children age and reach puberty. Initiative #109, therefore, requires all interscholastic and intermural athletic programs to be expressly designated based on biological sex as either for men, women, or coeducational (co-ed). School and athletic organization policies that undermine the biological reality of a person's body as male or female deny human dignity and are abusive to minors. Policies that allow biological men to participate in women's sports promote the unfair treatment of women and pose potentially dangerous and inappropriate situations for young women, including sharing bathrooms and locker rooms with biological men. Title IX of the Education Amendments of 1972 was a needed landmark to establish equal educational opportunities for women. Initiative #109 keeps in continuity with Title IX, is important for the equal dignity of men and women and addresses the unfair competition and potential safety concerns for minors when biological sex is disregarded.” - Colorado Catholic Conference

It’s so poorly written that any girl could face an invasive gender check if she’s accused of being transgender. And with no appeals process, parents and families are left powerless to stop these invasive checks.

"Proposition 134 would require all 179 school districts, plus universities and athletic associations statewide, to adopt invasive gender-check policies to determine which teams students can play on based on biological sex rather than gender identity, from kindergarten through college. 

It's a statewide, one-size-fits-all mandate with no state guidance on how verification should actually work. All students of any age could have to go through whatever gender check process is created just to play sports, not just transgender students, since schools are on the hook for enforcement with no clear rules.” - Hands Off Colorado

“Questions about fairness and safety in competitive athletics are legitimate, but Initiative 109 imposes a one-size-fits-all rule based solely on biological sex, extending from collegiate athletics all the way to K–12 and intramural sports. It would exclude transgender girls and women from female teams regardless of age, sport, level of competition, or individual circumstances, while transgender boys and men could participate on male teams only when no corresponding female team is available. That rigid approach leaves schools and athletic governing bodies little ability to account for circumstances such as medical transition, hormone treatment, or the very different competitive considerations presented by different sports and ages. These complicated questions call for thoughtful, evidence-based policies rather than a sweeping statewide mandate.” - Eagle County Democrats
